Aligned with the City of San Diego's Climate Action Plan (CAP) of 2015

Which emphasizes the creation of energy-efficient buildings and the implementation of regulations to conserve and disclose energy usage, the Building Energy Benchmarking Ordinance was enacted by the San Diego City Council in February 2019. This ordinance aims to advance the goals outlined in the CAP by promoting energy efficiency in buildings throughout the city.

  1. Applicability of the Ordinance

The Building Energy Benchmarking Ordinance applies to two main categories of buildings:

  • Commercial buildings exceeding 50,000 square feet
  • Multifamily and mixed-use buildings greater than 50,000 square feet, with 17 or more residential accounts
  1. Compliance Requirements

Under the ordinance, affected building owners must submit energy data to the City of San Diego using the ENERGY STAR® Portfolio Manager®. This data submission is an annual requirement and must be completed by June 1st each year. The purpose is to enable the city to track and assess energy consumption trends and progress toward energy efficiency goals.

  1. Fines for Non-Compliance

Failure to comply with the ordinance may result in fines of up to $1,000. These fines serve as a deterrent to ensure that building owners adhere to the reporting requirements and contribute to the city’s efforts to improve energy efficiency and sustainability.
