Building Energy Saving Ordinance (BESO)

Purpose of the Ordinance

The BESO, introduced in 2015, aims to reduce energy consumption and improve sustainability in Berkeley’s building stock.

Applicability of the Ordinance

The ordinance covers commercial, multifamily, and public buildings of 25,000 square feet or more, as well as residential properties with 1-4 attached units.

Compliance Requirements

Owners must conduct energy audits adhering to ASHRAE Level II standards for buildings over 50,000 square feet and Level I for smaller buildings. Penalties for non-compliance include fines of up to $2,000, with additional charges applicable in cases of criminal negligence.
