The Building Efficiency 305 Program

Mandates owners of commercial buildings spanning 20,000 square feet or larger to annually report whole-building energy use data. Reporting obligations will be gradually implemented based on square footage, with requirements for buildings of 100,000 square feet and above commencing in 2023.

Purpose of Benchmarking

The program aims to enable building owners and tenants to gain insights into their energy performance relative to similar structures and identify opportunities for energy conservation.

Participation Requirements

Covered building owners of multi-family and commercial buildings with a floor space of 20,000 square feet or more and containing 5 or more units are obliged to comply annually with BE305.

Contents of the Report

The benchmarking report encompasses:

Basic building and property use particulars.

A comprehensive 12-month record of whole-building energy and water usage for the preceding year.

Reporting Procedures

Owners of commercial buildings exceeding 20,000 square feet must annually benchmark and report whole-building energy use data using the ENERGY STAR Portfolio Manager.

Initial compliance deadlines vary based on building size:

For buildings over 200,000 square feet, compliance is due by June 30, 2023.

For buildings between 100,000 and 200,000 square feet, compliance is due by October 1, 2023.

For buildings between 50,000 and 100,000 square feet, compliance is due by October 1, 2024.

For buildings between 20,000 and 49,999 square feet, compliance is required by 2025.
