The Philadelphia Building Energy Benchmarking Ordinance
Mandates:
All commercial structures exceeding 50,000 square feet, excluding multifamily properties, must undergo benchmarking and disclosure of energy and water consumption using Portfolio Manager.
Sellers or lessors of buildings are obligated to furnish prospective buyers or lessees with a Statement of Energy Performance upon request.
Policy Objectives
The ordinance serves dual purposes: enhancing energy efficiency within the built environment and reducing energy expenditures. Oversight of the city’s energy benchmarking program is managed by the Office of Sustainability, facilitating building owners in curtailing energy consumption and achieving cost savings.
Applicable Entities
Commercial or multifamily building owners or managers in Philadelphia overseeing indoor floor spaces greater than 50,000 square feet are obliged to submit energy usage reports in compliance with this ordinance.
Submission Deadlines
Annual reporting deadlines are set for June 30th of each calendar year.
Reporting Procedures
Building owners are required to submit their energy consumption data to the EPA’s Portfolio Manager platform.
Penalty Structure
Failure to comply within the initial 30-day period incurs a penalty of $300, followed by additional fines of $100 per day thereafter. Penalties are imposed to ensure adherence to regulatory requirements and foster compliance with energy benchmarking obligations.
