Energy and Water Building Performance Ordinance (EWBPO)

Purpose of the Ordinance

San Jose’s EWBPO, enacted in 2018, promotes energy and water efficiency through audits and performance tracking.

Applicability of the Ordinance

The ordinance applies to commercial and multifamily buildings of 20,000 square feet or more and city-owned properties of 15,000 square feet or more that do not meet performance targets.

Compliance Requirements

Owners must conduct energy and water audits or retrocommissioning. Fines for non-compliance reach up to $100 per day for larger buildings and $50 per day for smaller properties, with annual caps.
